Object
These general contracting conditions (hereinafter, the "Conditions") regulate the contracting of the services that are offered through the INSITU Website and the INSITU Application, as well as the rights and obligations of the parties, derived from the service provision operations agreed between them.
The aim of INSITU is twofold: on the one hand, to offer users from different sectors who wish to offer their professional services on the network the possibility of publishing advertisements and promoting them, thus reaching the desired consumer public and, on the other hand, to offer users who are looking to contract a service the possibility of finding it more easily and to compare different options in order to choose the one that best suits their interests.
Through INSITU, both parties win, in the sense that it acts as a facilitating intermediary in this procedure. Professionals looking to promote their services and consumers looking to hire them will be able to find each other more easily thanks to this platform/application.
INSITU will take care of the publication, management and promotion of the advertisements requested by the Users, depending on the subscription contracted and the fields chosen by the User. INSITU will also publish listings of Users, and will also offer the possibility of viewing articles that have been published by Users. INSITU may review advertisements prior to publication to ensure that they comply with the Platform's standards and do not contravene any regulations.
With respect to the relationship between Users, INSITU will only act as a facilitator in bringing them into contact with each other. Subsequently, offerers and demanders will be able to establish the terms and conditions they wish with respect to the provision of the service. INSITU shall not be involved in any way in the execution or provision of the services offered by the professionals and therefore shall not be responsible for the quality or performance of such services.
To this end, in addition to the usual means of contact, INSITU allows Users to chat prior to contracting any service, in order to find out what interests they have in common.
Minimum age and representation
In Situ 360 is intended for people aged 18 or over. People under 18 may not create or use an account, even with permission from a parent or legal guardian. Being technically able to complete registration does not establish eligibility.
Anyone creating or managing an account on behalf of a company or organisation must have sufficient authority to represent it. Published information and content must be accurate and respect the rights of the people concerned.
If you believe an account belongs to someone under 18, you may report it to support@in-situ360.com with the minimum information needed to locate it. Do not send identity documents or other sensitive information unless this is reasonably requested through an appropriate channel.
When we become aware of an account that does not meet the age requirement, we will take the necessary steps to restrict its use and address deletion of the data, subject to applicable preservation or safeguarding obligations. This eligibility rule does not exclude legal obligations that may arise concerning children's data.
Registration on the Website by Users / Customers
Registration on the Website or the Application shall be free of charge and must be carried out by persons of legal age. By creating a Client account, or by contracting any service, the User agrees to be responsible for the data they submit and the services they offer, which shall not be offensive and may not contravene applicable legislation.
Such data shall be kept up to date, and the User shall ensure the security of his Customer account and access credentials, and shall be solely responsible for the activities carried out through his account.
The user may not transfer his/her account to third parties without INSITU's prior consent, and INSITU reserves the right to suspend or cancel the user's account in the event of non-compliance with this clause. INSITU may also verify at any time the identity of registered users, especially if it detects any suspicious activity that implies a breach of these terms and conditions.
Of course, the User shall not use or impersonate another person's account or provide false information through their account in order to mislead. Any such conduct shall entitle INSITU to terminate your account, without prejudice to any legal action it deems appropriate.
Any unauthorised use of your account must be immediately notified to INSITU by the User.
Service contracting
The contracting of a service through the Website or the INSITU Application implies acceptance by the User of all the conditions stipulated in this document.
In order to be able to contract the services offered by INSITU, the User must have previously registered.
When contracting the service, choosing and paying for the chosen subscription, as well as any additional amount for further promotion, the price and conditions will be indicated to the user in advance, before any payment is made.
In the event that users enter into an agreement with each other for the provision of a service, payments between them will not be made through the platform/application.
For any clarification, to make a complaint or if an incident arises in relation to your service, the User can contact us at support@in-situ360.com.
Recruitment process
Bidders on the INSITU platforms will be professionals who wish to reach the consumer public. In general, but not always, they will do so by publishing and promoting advertisements related to their services, all through the Website and the Application, with the information they consider relevant.
The buyers or demanders will be the Users who are looking for a specific service, being able to filter their search according to the fields they wish, such as location, or estimated price, in order to find the one that best suits their interests.
The contracting of the service through the website will be done when the User chooses the subscription he/she wants, depending on the functionalities he/she wants to have available. Registration on the website/application will be free of charge. However, a monthly or annual subscription will be charged, if you wish to obtain a premium subscription. Bidding Users shall also be required to pay the corresponding amount when requesting the publication of an advertisement. If Users wish to promote their profiles, they shall pay an additional fee.
The choice of one or the other subscription will also allow Users the possibility of contacting other unknown Users through the website or application. The contracting of the service, as well as the additional payments, which may be one-off or periodic (monthly, or yearly) must be made through the website or the application, accepting the conditions established by INSITU.
In order to contract the services offered by INSITU, you must fill in the fields with the required data and accept these Terms and Conditions. This acceptance shall signify express, full and unreserved conformity with the entirety of the general conditions set out in the version published by INSITU and shall be binding on both parties.
INSITU will ensure that all services offered have the legal coverage, quality guarantees and, where appropriate, the corresponding insurance.
To make payments for services, INSITU uses third party providers such as payment gateways and other transaction processors Each has its own conditions and policies, and each provider will be responsible for the security and confidentiality of transactions. All transactions will be made through secure payment platforms and with total guarantee of confidentiality of your data. Users may pay by credit card, Paypal or Apple Pay.
After validation of the payment, the transaction will be final and you will receive a confirmation email detailing the details of your transaction.
Payments or transactions between Users for the services provided shall be made on such terms and conditions as may be agreed between them, and INSITU shall not be liable in any way for any disputes that may arise between Users as a result of the services provided.
Prices
The price of services, subscriptions or additional promotional payments is as indicated at any given time on the platform or in the application. The prices set or published by Users in respect of their professional services are not set or controlled by INSITU.
The prices shown do not include VAT or the corresponding tax depending on the territory.
Pricing error
If it is detected that there has been an error in entering the price of a subscription or the publication of an advertisement after the User has contracted or paid for it, INSITU shall inform the User who booked it as soon as possible in order to inform him/her of the incident and offer him/her the option of cancellation or maintenance under the correct conditions.
The automatic confirmation does not validate erroneous price conditions. In case of cancellation, any amount paid by the customer will be refunded.
The definitive price will be that in force in the advertising coinciding with the moment of formalising the contracting of the service, without prejudice to any updates that may take place.
The Proprietor makes every effort within its means to provide accurate and typographical error-free information on its website and in its application.
Other expenditure
In the event that there are additional costs for the service, they will be communicated to the Client and itemised in the final price prior to payment for the contracting of the service.
Consumers' right of withdrawal
If you purchase an In Situ 360 service at a distance as a consumer and Spanish or European Union withdrawal rules apply, you generally have fourteen calendar days to withdraw from the contract without giving a reason. For service contracts, the period runs from conclusion of the contract, not from the first use of the service. Any extensions or more favourable statutory or contractual periods will apply.
The previous version of these terms referred to thirty days. This update does not reduce the rights of anyone who purchased under a version, offer or confirmation granting that more favourable period. A conflict between versions will not be used to deprive them of an applicable right.
To withdraw, send an unequivocal statement before the deadline to support@in-situ360.com or the address in the Legal Notice, identifying the account and contract. You do not have to use a particular form or give a reason. You may use the model at the end of this section.
Where withdrawal applies, we will refund the amounts due without undue delay and no later than fourteen calendar days after you communicate your decision. The refund will use the same payment method unless you expressly agree to another method that does not cause you any expense. No withdrawal penalty will be charged.
If you expressly request that a paid service start during the withdrawal period, and the applicable information and consent requirements are met, you may have to pay a proportionate amount for the service actually provided up to your withdrawal. Merely accessing an account or generally accepting these terms does not, by itself, constitute that express request.
For a paid service, the right may be lost through full performance only where all legal requirements are met, including prior express consent to begin and acknowledgment that full performance will result in the loss of the right. If digital content is supplied without a tangible medium, its specific exception applies only where all statutory requirements are met, including prior authorisation, information about the loss of the right and the required confirmation. Not every subscription is presumed to be digital content subject to that exception.
Where correct withdrawal information has not been provided, the statutory consequences and extensions apply. Expiry of the withdrawal period does not remove rights relating to lack of conformity, breach of contract, incorrect charges or other statutory grounds.
Contracts entered into for business or professional purposes do not receive a general consumer withdrawal right unless it is provided by the offer or applicable law. Consumer status depends on the particular transaction, not solely on the platform's name or professional subject matter.
Paid plans, renewal and cancellation
The included features, price, applicable taxes, currency, duration and billing frequency of each plan must be provided before the purchase is confirmed. Available payment methods are those displayed during that process. Mention of a payment method in general or historical information does not guarantee its availability.
A free trial or subscription will become a charge or automatic renewal only where its terms have been clearly disclosed and the required authorisation has been obtained. Price changes and renewal reminders will be communicated where and with the notice required by applicable law. Payment does not remove any applicable cancellation, refund or complaint rights.
You may tell us that you do not wish to renew by emailing support@in-situ360.com and identifying the account and subscription. You may also use the cancellation mechanism available through the channel where you purchased the subscription. There is no general requirement to give ten days' notice of non-renewal. Any more favourable mandatory rights or expressly offered terms will be respected.
Non-renewal prevents charges for subsequent periods and does not, by itself, entitle you to a refund for the period already purchased. This does not limit refunds due for withdrawal, lack of conformity, breach of contract, incorrect charges or other applicable rights. Cancelling renewal, withdrawing from a contract and deleting an account are separate actions.
Where an app store or another intermediary handles billing, information will be provided about who takes payment and the relevant procedure. Its rules do not replace or reduce the user's statutory rights.
User obligations
Users must use the website and app lawfully, provide accurate information, protect account access, respect intellectual-property, privacy and image rights, and follow the acceptable-use rules below. INSITU360, S.L. may request proportionate verification and restrict or terminate service for a material breach, subject to required notice, reasons and review rights.
Intellectual property and user content
In Situ 360's brand, software, design and proprietary materials belong to INSITU360, S.L. or their respective owners or licensors. Using the service does not transfer those rights.
Users retain their rights in their photographs, videos, audio, text, portfolios and other content. Publication on the platform does not transfer ownership to In Situ 360. Anyone providing content must have the necessary rights, permissions and other lawful grounds, including those concerning identifiable people appearing in it.
By adding content to the service, you grant In Situ 360 a non-exclusive, worldwide licence, without additional remuneration, solely to the extent necessary to host, store, technically reproduce, adapt for display, transmit and display it in accordance with the requested functionality and relevant audience. We may allow service providers involved in delivering the service to perform those operations, solely for that purpose and subject to applicable requirements.
The licence does not authorise independent sale of the content, use in advertising campaigns unrelated to the presentation of the service you have requested, or training of general-purpose artificial intelligence models. Any additional use requiring separate authorisation or a specific legal basis must have that authorisation or basis.
The licence ends when the content is removed from the service, except for operations strictly necessary to complete removal and uses or retention permitted by law. Backup copies or copies lawfully retained by other people do not give In Situ 360 a general right to exploit the content afterwards. Applicable rights to deletion, retrieval of content and data protection will be respected.
Changes to the terms
The terms may be updated to reflect changes in law, security or the service. Material changes will be communicated clearly before they apply, with the notice and through the means required by law or the contract. Acquired rights and the financial terms of a period already purchased will not be changed retrospectively to a user's disadvantage unless there is a lawful basis and justification for doing so.
Where a change requires fresh acceptance or consent, publication or silence will not replace it. Where a change gives a right to terminate the contract, information will be provided about that right and its financial consequences. Urgent measures required by law may be taken without ordinary advance notice, with information provided where appropriate.
Nature of the platform and current features
In Situ 360 is a professional networking service for personal and business profiles. Features include profile publishing, professional advertisements and promotion, search, Favorites, connection requests, chat, permitted attachments, reviews, reports, notifications and subscription plans. Features can depend on the plan, platform, deployment flags and app version.
Accounts, visibility and security
Users must provide accurate, lawful and current information, keep credentials confidential and use only an account they are authorised to control. Account type is selected at registration. Users choose profile visibility, but information deliberately sent to another user or linked externally may remain available in that context. Suspected unauthorised access must be reported promptly.
User content and licence to operate the service
Users retain ownership of content they upload. They grant INSITU360, S.L. a non-exclusive, worldwide licence, for the time the content is hosted and for a reasonable technical wind-down period, to host, store, reproduce, transmit, display, format, create technical thumbnails or previews, moderate and make the content available as required to operate and secure the service. The licence may be sublicensed only to operational providers for those purposes.
The user confirms that they own or have the rights, licences, releases and permissions needed for works, music, images, trademarks, personal data and people depicted. The licence does not authorise unrelated advertising use, sale of user content or training general-purpose artificial intelligence models unless a separate, clear agreement is made. Legal holds, backups and evidence needed for disputes may survive deletion for the required period.
Acceptable use, reporting and moderation
- Do not upload or send illegal content; threats; harassment; hate; sexual exploitation; fraud; impersonation; spam; malware; unlawful goods; or content that infringes privacy, image, intellectual-property or other rights.
- Do not scrape, crawl, harvest, reverse engineer, bypass plan controls, abuse automated access, manipulate reviews or use another person's account without authorisation.
- Use the report controls where available and identify the content and reason accurately. Knowingly false or abusive reports are prohibited.
- In Situ 360 may investigate, limit reach, remove content, restrict features, suspend or terminate accounts and preserve evidence where reasonably necessary. Except where law or urgent risk prevents it, users should receive information about material moderation decisions and available review channels.
Content is not comprehensively reviewed before publication and no outcome or response time is guaranteed. A public electronic contact route remains available for support and notices. Reports involving an immediate threat to life or safety should also be made to the competent emergency or law-enforcement authority.
Connections, chats and reviews
A connection request can be accepted or rejected; it is not a binding professional offer. Accepting may create a chat and use the request text as its first message. Chat participants are responsible for what they send and should not share secrets, payment credentials or unlawful files. Delivery, read status, attachment availability and uninterrupted retention cannot be guaranteed.
Reviews express the author's opinion. They must be based on a genuine interaction, be relevant and lawful, and may not be manipulated. In Situ 360 does not endorse, verify or guarantee each review and may remove or restrict reviews that breach these Terms or the law.
Plans, subscription access and account deletion
Plan I, Plan S and Plan 360 provide the capabilities described on the current plans page, including any advertisement-publication or promotion options displayed for the selected plan. Product labels and limits are not guarantees of permanent availability. A valid trialing or active subscription may provide the contracted plan's capabilities; payment failure, expiry or cancellation can affect future access according to the checkout terms and mandatory law.
Users can start account deletion from Settings > Configure my account > Delete account. Deletion is separate from subscription cancellation and may not cancel an external billing agreement automatically. Certain information may be retained or blocked for tax, accounting, security, fraud prevention, moderation, disputes, backups or other legal obligations.
Third-party services, availability and changes
The service depends on providers including Supabase, Stripe, Google location services, Apple and Google push services and external links chosen by users. Secure checkout may offer credit card, PayPal and Apple Pay. The providers' availability and separate terms may affect particular functions. In Situ 360 is not responsible for third-party content or failures beyond its reasonable control, but this does not exclude responsibility that cannot lawfully be excluded.
The service may change, be maintained or be discontinued. Material changes to paid services or these Terms will be communicated with the notice and rights required by applicable law. No clause limits liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer and data-protection rights.
In Situ 360's role and liability
In Situ 360 facilitates professional and business profiles, professional discovery, publication of information and connections between users. The terms of an In Situ 360 subscription are separate from the terms of work or services that users agree between themselves.
Unless expressly stated otherwise for a particular transaction, INSITU360, S.L. is not a party to a professional contract between users and does not act as the employer, representative, insurer or guarantor of anyone publishing a profile. The parties are responsible for checking identity, authority, permits, insurance and other conditions relevant to their professional relationship. The presence of a profile, portfolio or review does not, by itself, certify those matters or promise employment, engagements or results.
People who publish content or provide information are responsible for their own conduct as provided by law. This does not remove In Situ 360's obligations concerning its own service, personal data processing or action in relation to illegal content.
Uninterrupted availability and the complete absence of errors are not guaranteed. This statement does not exclude applicable duties of care, security, service conformity or remedies. Nor does it limit liability for intentional misconduct, gross negligence or any other liability that cannot lawfully be excluded or limited.
Links to external services do not mean that In Situ 360 controls their content or terms. Review the provider's information before using an external service. Nothing in these terms limits mandatory rights of consumers or other people protected by applicable law.
Governing law, local rights and language
These terms are governed by Spanish law. This choice does not deprive consumers of the protection of mandatory provisions that apply to them, including, where applicable, the law of their habitual residence.
Disputes are subject to the courts with jurisdiction under applicable rules. Consumers are not required to submit exclusively to the courts of Barcelona or to waive remedies, collective actions or other rights that cannot validly be restricted.
Different language versions must be interpreted consistently. No language rule overrides binding contractual information given to a consumer in their language, resolves ambiguity against them, or excludes mandatory rights. The invalidity of one provision does not affect the others where the contract can lawfully continue without it.
Complaints
You may send questions or complaints to support@in-situ360.com or the address in the Legal Notice. Using this channel does not prevent you from approaching the competent authority, dispute-resolution body or court. This clause does not, by itself, declare membership of any arbitration or alternative dispute-resolution scheme.

I hereby give notice that I withdraw from my contract for the following In Situ 360 service. Service or plan purchased: Contract date: Contracting person's name: Email address associated with the account: Contracting person's address: Notice date: Signature, only if the notice is submitted on paper:
Content and reports
In Situ 360 must not be used to publish, transmit or promote illegal content, fraud, impersonation, threats, harassment, sexual exploitation, unlawful discrimination or infringements of intellectual property, image, privacy or data protection rights. Deliberately false reviews, deceptive reputation manipulation, nonconsensual distribution of intimate images and abusive use of the service for unsolicited communications are also prohibited. Legitimate professional criticism is not a violation merely because it is negative.
User content is not presented as exhaustively reviewed or verified before publication. To report content, email support@in-situ360.com, preferably with the subject “Content report”. You may use this channel without an account. Provide the exact location through a link or information sufficient to locate the content; explain your concern; provide your name and email address; and include a statement that you believe in good faith that your information is accurate and complete. Identification is not required for reports of child sexual abuse material in circumstances where the law permits those details to be omitted.
Do not download or redistribute illegal material to report it. Provide sufficient references to locate it and do not include personal information unrelated to the report. If someone is in immediate danger, also contact emergency services or the competent authorities; this channel does not replace an emergency response.
Where contact details are available, we will acknowledge receipt without undue delay and communicate the decision and relevant review options. Reports will be assessed diligently, objectively and proportionately, taking into account their seriousness and the rights of those affected. We may request necessary clarification without using this to impose unjustified requirements.
Measures may include removal or restriction of content, limitation of functions or suspension or closure of accounts where there is a legal or contractual basis. Seriousness, repetition, context and risk will be considered. The person affected will be informed of the reasons and available remedies, subject to statutory exceptions. Where automated means are used in a decision requiring disclosure, that information will be provided.
You may request review of a decision by emailing support@in-situ360.com with the subject “Content review”, identifying the decision and explaining your disagreement. The deadlines and safeguards applicable to the case will apply. This channel does not limit statutory recourse to authorities, courts or out-of-court mechanisms.
Copyright reports
If you believe content infringes your copyright, identify the protected work, the reported content and its location, and explain whether you are the owner or an authorised representative. Include your contact details and a good-faith statement concerning the absence of authorisation for the reported use, taking account of statutory exceptions and limitations. A disagreement or the presence of a work does not automatically establish infringement.
Submitting a report does not guarantee it will be upheld. Necessary information may be shared with the affected person so they can respond, while protecting information that need not be disclosed. Repeated established infringements may result in account closure, subject to applicable law and safeguards. This procedure does not limit specific procedures under copyright law.
Removal of intimate images shared without consent
Sharing intimate images or videos of a person without their consent is prohibited, including manipulated or digitally generated content depicting them in an identifiable way.
If you are depicted in the content, or are authorised to act on the affected person's behalf, you may request removal by emailing support@in-situ360.com with the subject “URGENT — Nonconsensual intimate images”. You do not need to create an account or be an In Situ 360 user.
To enable us to handle the request, include enough information to identify and locate the content, a brief statement that the depicted person believes in good faith that publication of the image was not consensual, together with any relevant information to assess the lack of consent, a way to contact you and your physical or electronic signature. When submitting a request for yourself, the statement concerns your own good-faith belief. You may sign electronically by typing your full name with the intention of signing the request. If acting as a representative, state that role. You do not need to attach the intimate image itself or an identity document as a default requirement.
Where the United States TAKE IT DOWN Act applies and we receive a valid request, we will remove the content as soon as possible and in any event within forty-eight hours of receipt. Within that same period, we will make reasonable efforts to identify and remove other known identical copies of the reported content. This duty is not limited to images created using artificial intelligence.
Information in the request will be used to handle it, protect the people affected and meet applicable legal obligations. Contact information will not be disclosed to the reported person unless there is a need and a lawful basis to do so. If the content concerns a minor or there is immediate danger, do not redistribute it and also contact the competent authorities.
